Could I Be Convicted of a Criminal Charge for my Traffic Violation
New York State recognizes several criminal traffic violations. These violations can result in jail time, hefty fines, license suspension or revocation, negative implications on immigration status, misdemeanors, or felonies. Some examples of potential criminal violations (link to criminal defense page) in New York include:
- Reckless driving
- Driving While Intoxicated (DWI)
- Driving While under the Influence (DUI)
- Driving While Ability Impaired (DWAI)
- Traffic violations that result in bodily injury or death
- Evading the authorities
- Driving with a suspended or revoked license
- Leaving the scene of an accident
How Does The New York Point System Work
The New York Driver Violation Point Systems helps the Department of Motor Vehicles identify high-risk drivers. If you are considered high risk, you may have your drivers license suspended or revoked, incur fees and State surcharges, or have to pay large insurance premiums. The New York State DMV may suspend your license if you incur 10 or more points within an 18 month period. If you receive 6 or more points on your NYS driving record within a period of 18 months a Driver Assessment Fee will be assessed on you by the DMV, the fees start at $100.00 a year for a total of 3 years, any additional points received within that 3 year period will add an additional $75.00 per point to the yearly surcharge.
Out-of-state convictions do not add points to your New York driving record unless those convictions happened in Ontario or Quebec.
